1. Introduction

Welcome to CyberHub Pro. These Terms of Use govern your use of our website, facilities, and services. By accessing or using CyberHub Pro, you agree to be bound by these Terms. If you disagree with any part of these terms, please do not use our services.

These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and CyberHub Pro ("we," "us" or "our"), concerning your access to and use of our gaming center facilities, equipment, and website.

2. Eligibility

You must be at least 13 years of age to use our services. Users under the age of 18 must have permission from a parent or guardian and may be asked to provide proof of such permission. We reserve the right to refuse service to anyone for any reason at any time.

CyberHub Pro facilities and equipment are designed for use by individuals with basic computer knowledge and gaming experience. Users are expected to handle all equipment with care and follow staff instructions regarding proper use.

3. User Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to restricting access to your computer and/or account. You agree to accept responsibility for any and all activities that occur under your account and/or password.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel memberships at our sole discretion.

4. Facility Rules and Conduct

While using CyberHub Pro facilities, you agree to abide by the following rules:

No food or drinks near computer equipment
No disruptive behavior, including excessive noise
No installation of unauthorized software on our systems
No access to illegal or inappropriate content
No harassment of other users or staff
No damage to equipment or facilities

Violation of these rules may result in immediate removal from the premises and termination of your membership without refund.

5. Reservations and Cancellations

CyberHub Pro accepts reservations for gaming stations, streaming rooms, and tournament spaces. Reservations must be made at least 24 hours in advance and may require a deposit. Cancellations must be made at least 12 hours before the scheduled time to receive a full refund.

No-shows or late cancellations may result in forfeiture of deposit and may affect future reservation privileges. We reserve the right to release reserved spaces if you are more than 15 minutes late without notice.

6. Payment and Fees

Current rates for using our facilities are posted at our location and on our website. We reserve the right to change our rates at any time without notice. Membership fees are non-refundable except as specifically provided in these Terms or as required by law.

Payment is required at the time services are rendered unless you have an approved account with us. We accept major credit cards, debit cards, and cash. Late payment fees may apply to overdue accounts.

7. Intellectual Property

The CyberHub Pro name, logo, website, and all related content, features, and functionality are owned by CyberHub Pro or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any of the material on our website or from our facilities except as expressly permitted in writing by us.

8. User-Generated Content

Users may have the opportunity to create content while using our facilities, including but not limited to game recordings, streams, and social media posts. By creating such content at our facilities, you grant us a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, publish, and distribute such content for promotional purposes.

You represent and warrant that you own or control all rights in and to any content you create at our facilities and that such content does not violate these Terms or any applicable law.

9. Limitation of Liability

In no event shall CyberHub Pro, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our facilities or services.

CyberHub Pro assumes no responsibility for any personal belongings left or stored at our facilities. Users are responsible for securing their personal property at all times.

10. Indemnification

You agree to defend, indemnify, and hold harmless CyberHub Pro, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our facilities or services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes to these Terms constitutes your acceptance of such changes.

It is your responsibility to review these Terms periodically. We will notify registered users of material changes to these Terms via email or through a notice on our website.
